Terms of Service & Acceptable Use Policy

1) Definitions

  • “Company” means Lebanese For Advanced Information Technologies SARL and/or its brands “LFAIT” / “MFAIT” (collectively, “LFAIT”, “we”, “us”, “our”).
  • “Customer” means the person or entity purchasing, accessing, or using the Services (“you”, “your”).
  • “Services” include any hosting, dedicated servers, virtual servers, colocation-related services, networking, storage, security, software, support, trial services, and any related services provided by LFAIT.
  • “Customer Content” means any data, files, streams, media, software, configurations, or content uploaded, stored, processed, transmitted, or made available by the Customer through the Services.
  • “Support System” means the Company’s official ticketing/billing/support portal and related official communication channels.

2) Acceptance of Terms

By accessing or using the Services, placing an order, signing a written agreement, or paying any invoice, you acknowledge that you have read, understood, and agreed to be bound by these Terms of Service and Acceptable Use Policy (the “Agreement”). If you do not agree, do not use the Services.

3) Orders, Confirmation, and Right to Refuse

Clarification: Receiving an electronic receipt, invoice, or other confirmation does not constitute our acceptance of your order. We reserve the right, at our sole discretion and without prior notice, to accept, reject, cancel, or limit any order for any reason, including suspected fraud, risk, verification failure, or compliance concerns.

For card payments, approval is subject to authorization by the card issuer. We are not liable if a financial institution refuses to accept or honor a payment for any reason. We may request additional information or verification before service activation.

4) Account Eligibility, Email/Mobile Verification, and KYC

Email/Mobile Verification: Due to fraud risk, Customers may be required to verify their email and/or mobile number before accessing Services or placing new orders.

Client Verification (After Placing First Order): We may require identity verification (e.g., ID, proof of address/utility bill, or business registration) to unlock or continue Services. If you fail to provide requested verification within a reasonable timeframe, we may suspend or terminate the account. Services delivered or provisioned are generally non-refundable (see Section 9).

5) Service Delivery, Scope, and Promotions

  1. LFAIT will provide the Services as described in the applicable service description, order form, invoice, or written agreement. The Customer acknowledges being informed of applicable fees, conditions, and resource limits.
  2. Promotional offers apply only when explicitly stated in writing for your specific order/contract. Otherwise, promotions may not apply to your service.

6) Usage, Overages, and Resource Limits

If bandwidth, disk, IP usage, or other metered resources exceed the amounts included in your plan/contract during any billing period, you agree to pay any overage charges as invoiced. If payment is not made, we may suspend Services until all outstanding amounts are paid.

7) Payments, Invoices, and Non-Payment

Services depend on the receipt of payment. Unless otherwise agreed in writing, invoices are due on the service’s monthly anniversary date. We may apply late fees or administrative fees where permitted by law and may suspend Services after 7 days of non-payment.

If a card payment is rejected or reversed, we may assess reasonable processing/administrative fees (where permitted) and may require alternative payment methods.

8) Cancellation

Requests to cancel services must be submitted through the Support System (billing center/ticket portal). A cancellation confirmation is typically issued once processed. Cancellation stops future renewals; it does not retroactively refund already-paid periods unless required by law or explicitly stated in writing.

9) Refunds, Trials, and Chargebacks

Refund Policy: Due to the nature of online infrastructure and instant provisioning, services are generally non-refundable once activated/delivered, except where required by applicable law or explicitly agreed in writing.

Trial / Evaluation: If a free trial or evaluation is offered, it is provided “as is” for testing. Trial availability, duration, and conditions may change at any time.

PayPal / Card Disputes (Chargebacks): If you have a concern, you must contact support first through the Support System. Initiating a payment dispute/chargeback may result in immediate suspension to mitigate fraud risk. We reserve the right to contest disputes with logs and evidence where appropriate.

10) Services Are Legal — Customer Must Use Them Lawfully

LFAIT provides lawful infrastructure services (servers, networking, storage, security, and related services). We do not sell pirated content or encourage illegal activity. You are solely responsible for ensuring that your use of the Services complies with all applicable laws and regulations, including (without limitation) intellectual property, broadcasting, consumer protection, and data protection laws.

11) Customer Content, Streaming, and Third-Party Rights

Customer Content Responsibility: All Customer Content and any applications, streams, or services operated by the Customer using our infrastructure are the Customer’s sole responsibility. We do not create, upload, publish, curate, or control Customer Content.

Streaming / IPTV / Media: If you use the Services to stream, relay, distribute, or broadcast media, you represent and warrant that you own or have obtained all necessary rights, licenses, permissions, and authorizations. Any infringement, unauthorized broadcast, or violation by the Customer or the Customer’s end-users is the Customer’s responsibility, not LFAIT’s.

12) Acceptable Use Policy (AUP)

You agree not to use the Services for any unlawful, harmful, abusive, or disruptive activity. Prohibited activities include, without limitation:

  • Copyright infringement, piracy, unauthorized IPTV distribution, or unauthorized broadcasting of protected content
  • Malware, botnets, DDoS attacks, scanning/exploitation, or attempts to gain unauthorized access
  • Spam, phishing, fraud, identity theft, or deceptive practices
  • Hosting or distributing illegal content (including content prohibited by applicable law)
  • Operating services that materially disrupt our network, upstream providers, or third parties
  • Violating privacy/data protection laws or collecting personal data without legal basis

We may suspend or terminate Services immediately if we believe (in our reasonable discretion) that your activity violates this Agreement, poses legal risk, threatens security, or harms the network.

13) Abuse Reports, Copyright Complaints, and Cease-and-Desist

If you believe content or activity using our Services violates your rights or the law, you must submit a report through our Support System. To be actionable, complaints should include:

  • Your full legal name (or organization), contact email, and phone number
  • Clear identification of the allegedly infringing/abusive material or activity (URLs, IPs, timestamps, logs, screenshots)
  • Proof of ownership/authorization (for IP/copyright claims) or legal basis for the complaint
  • A good-faith statement that the use is not authorized and the information is accurate

Upon receipt of a sufficiently detailed complaint, we may (at our discretion):

  • Request additional information or verification
  • Notify the Customer and request prompt corrective action
  • Apply technical mitigations or temporary suspension while investigating
  • Terminate repeat offenders or severe violations
  • Cooperate with lawful requests from competent authorities where required

Notice-and-Action: We aim to act reasonably and promptly, but response time depends on severity, evidence quality, and operational constraints.

14) Law Enforcement / Legal Cooperation

We may comply with lawful orders, subpoenas, or requests from competent authorities as required by applicable law. Where legally permitted, we may notify the Customer of such requests.

15) Free Services Policy (If Offered)

If LFAIT offers any free services or free trials, the following rules apply:

  • Each Customer is entitled to one free service/trial unless otherwise stated.
  • Multiple registrations or attempts to obtain multiple free services are prohibited.
  • Abuse of free services may result in immediate termination of all related accounts and services.
  • Free services are subject to fair use limits and may be reduced, suspended, or discontinued at any time.

16) Limited License (Software / Portals / Tools)

If the Services include software, portals, scripts, APIs, or license keys, we grant you a limited, non-exclusive, non-transferable license to use them only while your service remains active and in compliance. Upon suspension/termination, your license ends, and access may be revoked.

17) Confidentiality and Account Security

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must promptly notify us via the Support System of any suspected unauthorized access.

18) Maintenance, Changes, and Service Modifications

We may perform maintenance, upgrades, or changes that may affect service availability. We may modify or discontinue parts of the Services at any time, with or without notice, as permitted by law and contracts.

19) Warranty Disclaimer

To the maximum extent permitted by law, the Services are provided “AS IS” and “AS AVAILABLE”, without warranties of any kind (express, implied, or statutory), including warranties of merchantability, fitness for a particular purpose, and non-infringement.

20) Limitation of Liability

To the maximum extent permitted by law, LFAIT shall not be liable for any indirect, incidental, special, consequential, punitive, or exemplary damages, including loss of profits, loss of data, business interruption, or reputational harm, arising from or related to use of the Services.

Where liability cannot be excluded, LFAIT’s total liability shall be limited to the amount paid by the Customer to LFAIT for the affected Service in the [30] days preceding the event giving rise to the claim (or the minimum required by law, if higher).

21) Indemnification

You agree to indemnify, defend, and hold harmless LFAIT, its directors, officers, employees, contractors, and partners from and against any claims, losses, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from: (a) your use of the Services, (b) your Customer Content, (c) your violation of this Agreement, or (d) your violation of any third-party rights.

22) Suspension and Termination

We may suspend or terminate Services immediately (with or without notice where legally permitted) if:

  • Invoices remain unpaid after the grace period stated in this Agreement
  • You violate the AUP or any material term of this Agreement
  • We receive credible abuse/copyright complaints, and you fail to act promptly
  • Your activity creates a security risk, legal exposure, or operational harm
  • Verification/KYC requirements are not satisfied

Termination or suspension does not relieve you of payment obligations incurred prior to the effective date.

23) Data Loss and Backups

You are responsible for maintaining your own backups unless a paid backup service is explicitly included in your plan. We are not liable for data loss resulting from Customer actions, third-party actions, or events beyond our reasonable control.

24) Third-Party Links and Services

Our website may reference third-party services or links. We are not responsible for third-party content, policies, or practices. Use of third-party services is at your own risk and subject to their terms.

25) Changes to This Agreement

We may update this Agreement from time to time by publishing a revised version on our website. Continued use of the Services after publication constitutes acceptance of the updated terms. If you do not agree, you must stop using the Services and cancel before renewal.

26) Governing Law and Jurisdiction

This Agreement shall be governed by the laws of [LEBANON], without regard to conflict of laws principles. Any disputes shall be brought before the competent courts of [BEIRUT/LEBANON], unless otherwise required by mandatory consumer protection laws.

27) Entire Agreement

This Agreement, together with any service descriptions, order forms, invoices, and referenced policies (including Privacy Policy) constitutes the entire agreement between the parties and supersedes prior communications.
